The Kardashians, Blac Chyna and Trademark Laws

Blac Chyna

Recently, news broke that the Kardashian sisters are opposing soon-to-be sister-in-law, Blac Chyna’s request to trademark her name as “Angela Renée Kardashian.” If you don’t know anything about Blac Chyna and the Kardashians, let us catch you up.

Reality TV stars, the Kardashians have been on the pop culture scene for quite some time. Rob the brother to Kim, Khloé, and Kourtney recently became engaged to Blac Chyna, the mother to his child, Dream Renée Kardashian. Blac wanted to protect the name she’ll take upon marrying Rob Kardashian so she filed to legally trademark her name as “Angela Renée Kardashian” to use while working in entertainment and on her social media but the three Kardashian sisters are blocking the trademark.

The reasoning? The sisters say that they would “suffer damage including irreparable injury to their reputation and goodwill” should Chyna take the Kardashian name.

So whether you care about the Kardashians or not, this brings up the perfect opportunity to talk about trademark rights. Leslie C. Adams who practices Intellectual Property and Litigation here at Haile Shaw & Pfaffenberger states that, “although surnames are in general offered little trademark protection, in this case I think there are good arguments on both sides. Doubtful it will go too far before settling on some restrictions of use, but it would be fascinating to know the outcome if it did go all the way through to the decision by the Trademark Trial and Appeal Board.”
